UNBROKEN SPIRIT

Unbroken Spirit is a true account of the poverty of the underprivileged in nineteenth century England. It also tells of the consequences suffered by William Boxhal, who was one of the thousands who transgressed the law.
It is a graphic story of Boxhal's degrading imprisonment for three years in England, especially the eighteen months of hard labour he spent in the rotting hulk, the Defence, on the Thames.
His transportation to the Swan River Colony in 1856, crammed on the William Hammond with 250 other convicts, is vividly depicted.
But it is Boxhal's time following his ticket-of-leave, contracted to Bishop Salvado at New Norcia, his marriage, the raising of a large family and the successful development of a prosperous farm without capital that demonstrates the unbroken spirit.
He was one of only about five percent of the convicts who came to Western Australia to survive and rise above their incarceration and discrimination.

Jane left John and he kept Violet Owen, and her Grandparents helped raise her. Jane kept Ethel Kate. There was always some doubt if John Edward was her Father.
Jane was still married to John when she went through a form of marriage to a James Muir in Hughenden. They had five children. She also married another man while John Edward was still alive. When children of Violet traced her family by James Muir down, they did not want to know anything about Violet, so sadly she never got to meet her half sisters & brothers. Violet had always been told her Mother was dead.

One story I have heard about Elanor Brady's brothers and it has been confirmed by a newspaper report was that they were so incensed at seeing the British flag flying over the UTAKARRA railway station that they hauled it down and burn it. They were imprisoned for the offence.

Elanor was quite a character she was a horse breaker and carried a pistol on her almost up unil the day she died or so I am told. I noticed in one instance that her second husband is listed as Peter Paterson. I have always know him as Peter Peterson and that he was Swedish. How true this is as I have never checked the marriage records. My father remembers him and says he was definately Scandanavian.

When I said in my first e-mail I remembered Elanor Brady that could not have been correct as she died before I was born in 1946. As Beatriced lived in Wellington St we used to visit the house were Elanor and Peter Peterson lived as Beatrice knew the people living there and it was on the way to mass at St Mary's. She lived at 30 Wellington St. I clarified this with my Dad to day. Just goes to show you can build a false memory.

1918 Sept. 24th Dongara News - Local folk will regret to learn that Private Fred Brady, of the Irwin, is in hospital in England necessitating an operation on his heart. We extend sympathy to his wife and six daughters.
1918 Oct.24th - Dongara News (Oct.21) the friends of Private Fred Brady will be glad to hear that the operation has been successful, and that he is progressing after 3 or 4 critical days.
1918 Nov.5th Dongara News (Nov 4) Two more of our local soldiers are on the water, Private Jack Sloper (whose English wife follows him shortly), and Private Brady who has 6 months furlough.
1919 Jan.30th Dongara News (Jan.28) It is reported that Private Fred Brady, of the Irwin, has landed safely at Fremantle, and is expected home by the earliest possible train.
1919 Feb.18th Dongara News (Feb17) A welcome social was tendered to Privates Harry Browning, George Bridges and Fred Brady. Unfortunately only one, Pvt. Henry Browning was able to be present.
Private Fred Brady, who was recently returned, was stretcher bearer, and risked his life repeatedly to save his wounded comrades, until overstrain of the heart, necessitated his being declared “hors de combat”
1919 Feb.25th Dongara News - The third event (social in the week) was a welcome social at the schoolhouse at the Irwin, tendered to Private Fred Brady, who has for many years worked on the line for the Midland Railway Company. A bumper house, and an enjoyable programme helped to show that his country cousins appreciated and hailed his return.

1919 June 26 Dongara News (June 25) On Friday last a welcome social was tendered to Privates Fred Brady, Robert Parker & Harry Rowland. The first named was gassed and the last named was invalided home through rheumatism, but Private Parker returned without a scratch.

Harry was a member of the 11th batallion in WW1. His Regimental No was 4328. He served in France and was repatriated to England after being wounded. Henry and his wife, Annie Elizabeth Baigent, left on the Konigen Louise in June 1919 and arrived in Fremantle in August 1919. The Konigen Looise was an ex German liner of 10,566 tonnes taken over by the British as a transport ship for returning troops to Australia. It was sold to the Orient Co in 1920 and renamed the Omar

Harry was one of the original Diggers in Gallipoli. Fred Brady was also there however to my knowledge he was sent home because they were brothers. Harry also spent several years in France during WW1. He met his wife after being wounded, she was a nursing sister during the war. He must have impressed her, she married him, came to WA, and never saw her family in England again.

1919 Aug. 21st Dongara News (Aug 18) On Wednesday evening last our Irwin friends welcomed home Privates Jack Hendy and Harry Brady and his English bride, with a pleasant little social and dance. Mr. Irwin Burges kindly took the chair. Both David and Elizabeth were unable to sign their names when they married. David, along with his parents and siblings arrived at Fremantle aboard to 'Palestine' on 28 April 1853. 1869 David married Elizabeth at the home of Mr Robert BELL by Rev. Charles CLAY. The wedding was witnessed by John KNAPP and John BROWNING (David's step father).David was 27 and Elizabeth was 21.
Their first child was born at Irwin River. When Elizabeth died in 1884, David was left with 5 children aged from 13 to 2 yrs old. In just 9 years he loses his wife and four of his children. 1896 David died, leaving his five children aged from George, 25 yrs old to Charlotte Elizabeth aged just 13 years. George marries in 1900 and his marriage is witnessed by David's step father, John BROWNING.

My g g grandmother was a Brandis - Annie, d/o Edward, s/o Christopher (b c 1775 in WIL). I am beginning to research the UK Brandis lines.
Looking at your info on William Brandis (bap 08 Dec 1811), s/o David Brandis and Mary, I notice that you identify Mary as Mary Tims. According to the IGI, a David Brandis married a Mary Tims in Kineton on 02 Oct 1823 which, if correct, seems a little late?
I have also found a marriage for a David Brandish and a Mary Boulter in Loxley, on 10 Oct 1793. Loxley is between Combrook and Stratford on Avon. Do you have anything that would rule out this marriage and/or confirm a marriage to Mary Tims? The date seems more plausible and the spelling a common enough 'variant'. What do you think?

Location: Labuan is a small island in Brunei Bay, off the coast of north-west Borneo. The island is best reached by air from Kuala Lumpur, the Malaysian capital, from where there are daily flights. There are also flights from Singapore and Manilla. The cemetery lies on the right side of the Jalan Tanjong Batu road, which leads from the airport to the town. The Cemetery is close to the airport, within a short taxi ride, and about 3 kilometres from the Island's town, Victoria, Within the Cemetery will be found the Labuan Memorial and the Labuan Cremation Memorial.

From The North Midland Times newspaper, Friday 15 January 1937:
"Another fatality occurred at Dongara last week-end when a young man, Sydney George (Jim) Brandis (21), employed by Mr. Bert Watson, of Strawberry, was fatally injured in a motor smash. The accident occurred about one mile from Dongara on Saturday night when Laurie Selwood, of Mingenew, and Brandis were riding a motor cycle from Dongara to the beach. The motor cyclists were some distance behind a motor truck, travelling in the same direction, and it appears that the truck, which was driven by Gordon Tamblyn, had just topped a rise when the lights failed. When Selwood, who was driving the motor cycle, topped the rise he was confronted with the truck standing in the middle of the road, he swerved sharply to the left to avoid the verhicle, but the right hand handle-bar caught the back of the vehicle and Brandis was thrown heavily against the truck. He sustained multiplex injuries including a shattered hip, broken rubs, internal injuries and head injuries. The injured man was conveyed to the Geraldton Hospital where he succumbed at 6 a.m. next morning. The remained were interred in the Geraldton cemetery at 3 p.m. on Monday. Janice Hayes has a letter from the Comptroller General in Perth pardoning William as he saved a Warder, therefore was given a pardon early.

Little is known of William prior to his arrival except that he was born to Thomas and Catherine. He worked as a Baker and Framework Knitter, he was a Widower and Literate before he was transported.
William (convict #3) was convicted with Samual Scattergood (convict #1) for sheep stealing as the Leicester Quarter Session, they were found guilty of Sheep Stealing and killing to steal the Carcass.
On the 9th March 1848 they were sentenced to be transported for a term of 15 years, William was held first as Wakefield Prison from where he was transported to WA on the "Scindian" which arrived in Western Australia on the first of June 1850. On arrival no facilities were available to house (or imprison) the Convicts. 20 Convicts were taken ashore daily to build a Prison to house all the prisoners (75 in total) The first Prisoners Nos. 1-20 would have included William.
He was 33 years old when he arrived, his description taken from the records as follows:
Height 5ft. 7 inches, Brown Hair, Hazel Eyes, Dark Complexion, Oval Face, Stout Build, Small Scar inner corner of the left eye brow. He was granted T/L on the 4th March 1851. He received his full pardon on the 4th November 1851.
WILIAM RECEIVED HIS FULL PARDON EARLEER THAN USUAL THROUGH HIS RESCUE OF A WARDER (John Carr)
The following is a description taken from Memorandum C.S.0.214-25 dated the 8th January 1851, to the Controller General
In January 1851 a party of Convicts were erecting a Bridge across the Swan River at Guildford. They were coming from the Fremantle Prison daily by boat to Mr. W. Hillman's Camp. The crew comprised of Mr. J. Carr (Warder in charge 4 convicts Thomas Adams (#131) John Morris (#122) Henry Perkins (#140) William Hayles (#141) stayed with the Boat while the others were out working on the bridge. William injured his leg and was sent back to the boat to be returned to Fremantle. When they reached Rocky Bay the crew requested that they be allowed ashore as they had a call of nature. They then overpowered the Warder and tied him up, when Branson refused to go along with their plans to escape they also tied his hands behind his back and left them on the foreshore. William after a time was able to free himself, he then released the Warder, who climbed the Cliff to raise the alarm. Leaving William on the shore because of his injury he was unable to climb. William was picked up next day.
The four escapees robbed a ship in Fremantle of food and clothing it is believed they intended to sail to Batavia, one of the Convicts had navigation knowledge. They were becoming short of water and put in at Sharks Bay to obtain further supplies, they were unlucky as a ship coming to Fremantle was moored in the Bay. They were recognized and arrested and returned to Fremantle. The following punishment was given. One man received 50 Lashes, the other three were given an extra three years hard labor in irons on top of their original sentences
Note: extract from my grandfather was a Policeman. The Perth Gazette of the 10th January 1851 announced that, "we believe this escapade" (The escape of the four Prisoners will cause the establishment of a Waterguard for the habour. On the 15th January, 1851 Governor Fitzgerald announced that he had made the following appointment.
I have appointed Mr. George Clifton formerly a Midshipman in the Royal Navy, Chief Officer of the Water Police at Fremantle at a salary of Ninety Pounds a year with barrack accommodation and rations. He will be supplied with a serviceable boat and a crew consisting of a Coxswain, to whom I have given a salary of forty-eight pounds per year, plus 4 Crew at a salary of forty pounds each with rations and barracks accommodation.
William on receiving his Ticket of Leave went to work for Walter Padbury. Who found him to be of good character and paid him One Pound Ten Shilling per month. Mr. Padbury advanced William the sum of Two Pound Ten Shillings to pay in full in Williams’s case the balance outstanding. Of Fifteen Pound, before the full pardon would be granted on the 4th November, 1851.
Some of the children of Margaret and William received some education when a Governess (Miss Groves was employed by Edmund Byrnes, Charles A Glover and John Thompson.) The date of Miss Groves employment is not certain but it was not before 1874. (Wannamal History Book B. Ruchenan). William had a lease on Swan 1024 which was a Kilometer west Thompson's Holding Swan 694.
In June 1857 William Branson signed an agreement with Bishop SaIvado For a period of three years ending 31st December 1860. This agreement was for a lease of 21 acres of land for three years and six months Lot No 2, which was 2 miles from the mission house. William had to clear and fence the land, erect a cottage sink a well to ensure a supply of water, he was to supply his own tools. Bishop Salvado was to supply Bullocks and plough, provide seed for wheat, also to supply flour, meat, tea and sugar. Any debts were to be settled by the Ist December, each year. William was to be given preference for renewal of lease. We believe the Lease was renewed.
At some stage William and his family moved to Bindoon, here he worked as a small farmer and carter at Seven Mile Springs and Gillingarra. Later he worked on Railway Construction. Bindon New Norcia was part of Victoria Plains.
Margaret Branson was Godmother to Thomas Boxall who was born on the 12th September, 1869 and was Baptised on the 2nd November, 1869 by Father Martinez at New Norcia. William was employed by Boxhall (Ref Unbroken Spirit by Brian Peachey)
William and his son Thomas took out 6 Leases of land in the Wannamal area Lot A4689, of 3,000 acres on 2nd February 1880 roughly between West Point Road and Hay Flat Rd., His address at this time was given as care of E. Wells Bindoon. This lease was sold to John Henry Monger in 1881. Special Occupation Lease 2062 was applied for on the 11th January, 1881 and was passed to J.H. Monger on the 31st August, 1882. They then leased A5837 of 5340 acres which in turn was also sold to J.H. Monger.
NOTE: William and Thomas had earlier recognized the possibilities of land at Wannamal as water was in good supply. Page 31 Wannamal History shows a survey map of Lot 1573, the original Lessee was T. Branson and was 100 acres, given up in 1896.

At that time they had three children Katie (eldest), Gregory and young Rodney. I noticed Rodney's death on your site. I visited them in 1972 and was told that Greg had been killed crossing the road at the bottom of their drive. Len's death was at a young age and I noticed two infants' deaths on your tree, I presume at or around birth - what a tragic outcome to what was an honest, hard working but struggling family.
I have attached a photograph taken around 1961. The young man on the left was an itinerant farm worker who Len and Joan had given work and shelter to.

Mary Ann Browne had another child before her marriage to John Finn in 1880 at aged 17 years. Her son Joseph Henry Brown was born in 1877 and is registered under "Brown", father unknown. He was known as Henry Joseph Finn all his life but whether John Finn was his father is not known. Henry Joseph Finn never married. He enlisted in the Army as a Gunner on 12th July 1915 aged 37 years. His Unit was 31st Battalion, C Company. The Unit left Melbourne on 9th November 1915 on the "Wandilla" for Suez. He was known as "Harry". He was killed in action at Ypres, Belgium on 23rd September 1917. He was buried where he died, however the grave was destroyed in subsequent fighting. He has no known grave. His commemoration details are at the Menin Gate Memorial, Ypres, Panel 7. Belgium. Also Panel No 16, Roll of Honour, Australian War Memorial, Canberra. His Service Record is digitised and available online through National Archives of Australia, also through the Australian War Memorial website (Red Cross Wounded and Missing). Eliza BROWNING was born in about 1814-16 in Tetbury. Her father, Isaac BROWNING is identified on her marriage certificate and she is also identified the mother of Frederick STOKES on his birth certificate.
Eliza married Thomas STOKES at Hempsted, Gloucestershire in 1840 and they had seven children, the first being christened in Churchill, Oxon where Thomas had been raised. Hempsted has a reputation amongst family historians for being a magnet for clandestine marriages, as often the bride and groom were not from Hempstead. It is also possible that the local vicar had a policy of offering "penny weddings", i.e. no fee weddings that was taken advantage of by non-residents.
It's possible that Eliza had had a child named Ellen Harding BROWNING in 1834several years before marrying Thomas STOKES in 1840. Ellen later emigrated to Australia so she should be found in the 1841 census with her parents. I have yet to search for this census record.
Based on the Harding name (which is not a BROWNING family name) it might be speculated that one of the two HARDING brothers - Thomas and Charles - was the father of Ellen. Thomas HARDING went on to have a large family in Tetbury so he is unlikely to be the father, however his younger brother Charles c.1809 either moved away or died young. Local burial records and parish records including paternity allegations should be checked.
I hadn't checked for an earlier marriage or children and so I hadn't found Ellen Harding BROWNING. I haven't found the 1841 census record for Thomas and Eliza STOKES yet, and Ellen is not on the 1851 with her mother (but she would have been 17 so not unsurprising perhaps).
Potential fathers of Ellen would presumably be the HARDING boys (Thomas and Charles) born about 1806-9. Thomas married and had loads of children in Tetbury. But what happened to Charles?
Some things to consider researching:
1. Does Ellen's original christening record suggest anything?
2. Is there anything in the Tetbury parish records about any paternity allegations? or poor law hardship payments for unmarried mother?
3. Did Charles die? Parish burial records
4. Find the 1841 census for Thomas and Eliza STOKES. They were in Hempstead, Gloucs in Sep 1840 but their first known child was born in Churchill, Oxon in 1843.

Records have hime as a yoeman in the Swan Districts, Chittering. A poultry farmer at Greenough during 1867-1885. And a labourer. Between the years1865-1869 he employed 8 ticket of leave men, including a builder in 1865, a well sinker in 1866 & a fencer in1869.
Coat of Arms
First, some basic info: coats of arms do not belong to surnames, they belong to individuals and families (i.e. actual relatives). There are more than one "Browning" coats of arms, each belonging to a different family named Browning. There are also undoubtedly many more Browning families which never have used arms at all. While its interesting to look up arms associated with folks of the same surname, you can't claim one or the other of the historically documented Browning coats of arms as "yours" any more than you can claim to be related to some historical Browning, unless & until you've done the genealogical research to prove (or more likely disprove) the relationship.
Having said that, the most frequently seen Browning coat of arms is that of Browning of Coaley (sp?) which at various times was recorded as "Argent three bars wavy Azure" (Silver or white shield with three wavy horizontal stripes) or "Barry wavy of six Argent and Azure" (divided into six wavy horizontal stripes alternately Silver or White, and Blue). There is a family of Brownings which settled in Connecticut in the 1600's IIRC which claimed to be descended from the Brownings of Coaley, and therefore used these arms; can't say whether the claimed descent was valid or not. The earliest Brownings to settle in Virginia never have, AFAIK, claimed descent from B. of Coaley; the oldest line of Virginia Brownings have been attributed a different coat of arms, but I've never been able to trace where they came from.
